General Terms & Conditions for Profile Perfect Inc.

At Profile Perfect Inc., we respect your rights and are committed to providing a high quality service that delivers on expectations. To do that, our terms and conditions explain what services we provide and the terms of providing those services. Services
Profile Perfect Inc. agrees to provide the client with professional photography and/or dating advisory services as described in the agreed-upon package or contract. The client understands that the photographer’s style and artistic interpretation may vary and that the photographer has creative control over the final images. The client also understands that the dating advisor’s recommendations and feedback are subjective and may vary, and that the client will exercise discretion over the implementation of any such advice.
Payment and Fees
The client agrees to pay the photographer and/or dating advisor the agreed-upon fee for the services rendered. Payment may be required upfront, or as per the agreed-upon schedule. If applicable, based upon the package purchased, Profile Perfect Inc. will honor the client with its “Because You Deserve It” Guarantee. Any additional fees, such as travel expenses, permit fees, prints/products, activities or resources recommended shall be paid by the client as agreed upon in writing.
Cancellation, Rescheduling and Refunds
If the client wishes to cancel or reschedule a session, they shall provide prior written notice to Profile Perfect Inc. by email as per the agreed-upon cancellation policy.
If the client cancels the session/event outside the agreed-upon cancellation policy, any payments paid may be forfeited, or a cancellation fee may apply, depending on the circumstances and timeline of the cancellation. Rescheduling of the session/event may be subject to availability and may be subject to an additional fee.
Refunds, if any, shall be determined in accordance with the cancellation policy and in conjunction with the guarantee policy. The client acknowledges that the photographer and/or dating advisor may have already incurred costs or expended efforts in providing the services, which may be deducted from the refund, at our discretion.
Copyright and Usage
Profile Perfect Inc. retains the copyright to all images taken during the session/event. The client is granted a limited, non-exclusive, and non-transferable license to use the images for personal, non-commercial purposes, including printing, displaying, and sharing online. The client shall not alter or edit the images in any way, nor sell or use the images for commercial purposes without written permission from Profile Perfect Inc.
Model Release
The client grants the photographer the right to use the images for promotional purposes, including but not limited to social media, website, blog, portfolio, and marketing materials, unless otherwise specified in writing by the client. Profile Perfect Inc. will seek to obtain prior written permission from the client.
Image Retention
Profile Perfect Inc. and the photographer shall retain the images for a period of time as agreed upon, but is not responsible for archiving or storing the images indefinitely. The client will be offered a specified amount of time to download and store the images. It is the client’s responsibility to back up and protect their images once delivered. Following the specified amount of time to download and store the images, Profile Perfect Inc. will no longer be responsible for archiving or storing the images and may be purged.
Client Responsibilities
The client agrees to provide accurate and complete information to the photographer and/or dating advisor, and to promptly notify the dating advisor of any changes in their circumstances or relationship status that may impact the advice provided. The client acknowledges that they are solely responsible for their actions, decisions, and outcomes in their dating life, and that Profile Perfect Inc., the photographer, and/or dating advisor shall not be held liable for any consequences thereof.
Confidentiality
Profile Perfect Inc. and the dating advisor agree to keep all information shared by the client confidential, unless required by law. The client acknowledges that sharing personal information with the dating advisor is voluntary and that Profile Perfect Inc. and the dating advisor shall take reasonable measures to protect the client’s privacy.
Liability
Profile Perfect Inc., its photographers and its dating advisors shall not be held responsible for any injuries, damages, or losses (indirect, consequential, or incidental) incurred during the engaged activities. The client is responsible for the safety and conduct of their own behavior and any / all individuals they involve in the photo session, and any damage caused by the client or their guests to the photographer’s equipment or property shall be reimbursed by the client. Profile Perfect Inc. assumes no liability in the facilitation of the engaged activities.
Limitation of Liability
Profile Perfect Inc. and the dating advisor’s liability for any claim arising out of or relating to the services provided shall be limited to the amount paid by the client for the specific service giving rise to the claim. The dating advisor shall not be held liable for any indirect, consequential, or incidental damages.
No Guarantee of Results
The client acknowledges that the dating advisor’s guidance and advice are subjective and that the dating advisor does not personally guarantee any specific results or outcomes in the client’s dating life. The client’s success in dating is dependent on various factors, including their own efforts, actions, and external circumstances beyond the dating advisor’s control.
Notwithstanding the aforementioned statements, Profile Perfect Inc. provides and will honor its “Because You Deserve It” Guarantee, provided that the client has purchased the applicable package. Additional details of the “Because You Deserve It” Guarantee is provided below.
Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Alberta, Canada without regard to its conflict of laws principles. Any dispute arising out of or in connection with these terms and conditions shall be resolved in the city of Calgary, Alberta, Canada where Profile Perfect Inc. is located.
Entire Agreement
These terms and conditions constitute the entire agreement between Profile Perfect Inc., the photographer, the dating advisor, and the client and supersede any prior negotiations, understandings, or agreements, whether written or verbal, relating to the subject matter hereof.
By engaging in services provided by Profile Perfect Inc., including services provided by its photographers and dating advisors, the client acknowledges that they have read, understood, and agreed to these terms and conditions in their entirety.
Cancellation Policy

To do that, our cancellation policy explains the terms and conditions of canceling or scheduling an appointment or service, and expectations of the client. If anything is unclear or if additional clarification is needed, please reach out at [email protected].
Cancellations 48 Hours Before Session/Event
If the client wishes to cancel or reschedule a scheduled appointment or service, they shall provide advance written notice to Profile Perfect Inc. at least 48 hours prior to the scheduled appointment or service with the photographer. Appointments or services canceled 48 hours prior to the scheduled session are eligible for a full refund, less payment processing fees and any applicable direct costs incurred or efforts expended by Profile Perfect Inc. or the photographer for the client’s benefit, e.g. photography props.
Cancellations Within 48 Hours of Session/Event
If the client wishes to cancel or reschedule a scheduled appointment or service between the 48 hour window prior to the scheduled session, Profile Perfect Inc. may cancel or reschedule the scheduled appointment or service at its discretion. For clarity, any payments paid may be forfeited, or a cancellation fee may apply, depending on the circumstances and timeline of the cancellation. Rescheduling the appointment or service may be subject to availability and may be subject to an additional fee.
No Shows
If the client fails to show up for a scheduled appointment or service without providing any notice or if the client is not available or reachable at the scheduled time, the dating advisor may charge the full fee for the missed appointment or service.
Cancellations After Session/Event
After the session has been fulfilled, the client understands and agrees that the client is no longer eligible for a refund. Instead, the client will be offered Profile Perfect’s “Because You Deserve It” Guarantee, provided that the client has purchased the applicable, eligible package. Additional details on the Guarantee are provided below.
Cancellations by Profile Perfect Inc.
Profile Perfect Inc., its photographers, and/or its dating advisors reserve the right to cancel or reschedule a scheduled appointment or service due to unforeseen circumstances, such as illness, emergencies, or other unavoidable events. In such cases, Profile Perfect Inc., its photographers, and/or its dating advisors will make reasonable efforts to notify the client as soon as possible and will work with the client to reschedule the appointment or service at a mutually agreed-upon time.
Refunds
If the client is eligible for a refund, to qualify for a refund, the client must submit a written request for refund within 30 days from the original scheduled appointment or service. The request must include a detailed explanation of the reasons for the dissatisfaction, along with evidence the cancellation occurred within the eligible window for a refund. The refund may be subject to additional inspection or inquiry by Profile Perfect Inc.
If Profile Perfect Inc. determines that the refund request is valid and justified, Profile Perfect Inc. will process a refund of the fees paid for the specific service or package within 14 days from the date of determination. The refund will be issued using the same method of payment used by the client for the original payment, unless otherwise agreed upon in writing. The refund does not apply to any additional fees or expenses incurred by the client, such as expenses for activities or resources recommended by the photographer and/or dating advisor, which are separate from the agreed-upon service or package. The refund is limited to the specific service or package for which the refund is being requested and does not apply to any other services or packages provided by the dating advisor.
The client acknowledges that in addition to the refund, Profile Perfect Inc. offers a “Because You Deserve It” guarantee which is an incremental remedy for any dissatisfaction with the services provided by Profile Perfect Inc. The cancellation policy and “Because You Deserve It” guarantee may be voided if the client has breached any of the terms and conditions of the agreement with Profile Perfect Inc., the photographer, and/or the dating advisors, or if the client has not followed the deemed reasonable advice or recommendations in good faith.
Changes to Appointments or Services
Any changes to scheduled appointments or services, such as rescheduling or modifications to the scope of services, must be agreed upon in writing by both parties.
Exceptions
The cancellation policy may be waived or modified by Profile Perfect Inc. in exceptional circumstances, such as documented emergencies or extenuating situations, at Profile Perfect Inc.’s sole discretion.
Termination of Services
The client may terminate the services provided by Profile Perfect Inc. at any time by providing written notice. However, any fees or expenses incurred by the client prior to the termination notice shall be non-refundable. Instead, the client will be offered Profile Perfect’s “Because You Deserve It” Guarantee, provided that the client has purchased the applicable, eligible package. Additional details on the Guarantee are provided below.

Overview of the Guarantee
This is a real guarantee: Profile Perfect Inc. will offer to either (a) continue working with you for free until you get the agreed upon results, or (b) process a full refund back to your original method of payment. For clarity, Profile Perfect Inc. reserves the right to choose which form of guarantee to honor.
Good Faith Efforts
In the event we elect to continue working with you, we will continue working with you for as long as you (the client) reciprocates with good faith effort by taking reasonable action on our deemed reasonable recommendations. For example, we may recommend you to improve your fashion style or to lose weight in order to become more congruent with your personalized dating strategy and to improve your likelihood for success.
Refusal To Cooperate in Good Faith
In the event that the client refuses to take reasonable action on our deemed reasonable recommendations, you (the client) thereby release Profile Perfect Inc. from any and all ongoing obligations to uphold the guarantee. In other words, if the client refuses to continue working with Profile Perfect Inc. in good faith, then the client acknowledges and agrees that Profile Perfect Inc. is no longer obligated to continue working with the client for free and is released from any obligation or requirement to process a refund.
Termination of Guarantee
Profile Perfect Inc. reserves the right to terminate the Guarantee if we have reasonable reason to believe that there is an ongoing effort to commit fraud or commit other similar nefarious acts, or if the client behaves in an abusive manner. For example, if the client intentionally lies or misrepresents the results you are experiencing in order to obtain continued free services, we reserve the right to deem the services rendered, terminate the client relationship, and nullify the Guarantee.
